Post-Trial Motions in EF! / FBI Case

An important hearing on post-trial motions by both sides will take place before federal judge Claudia Wilken on Friday November 1, 2002, beginning at 10 a.m. in the Federal Courthouse at 13th and Clay Streets in Oakland, California.

The Oakland and FBI defendants have filed separate motions seeking to overturn the unanimous jury verdicts against them, and also seeking to set aside or reduce the $4.4 million damage award. The Oakland defendants seek a new trial.

Attorneys for Judi Bari and Darryl Cherney have also filed a post-trial motion seeking a new trial to include the six FBI higher-ups who were let out of the case by the court before the trial began. This group includes COINTELPRO master Richard W. Held, who was the Special Agent in Charge of the San Francisco office of the FBI at the time of the attempted frame-up in 1990.

This will probably be the final hearing in Bari vs. FBI at the federal trial court level. Assuming all post-trial motions are denied, the appeals process will begin, and the case will move to the jurisdiction of the Federal 9th Circuit Court of Appeal in San Francisco.

It is important for supporters to attend this hearing to show that the public is interested in this case. Jurors said they took note of the full courtroom every day of the six-week trial last April and May, and it influenced them positively.
