Searches of opponents of
GMOs in Belgium: judicial enquiry or political punch below-the-belt?

CAGE (the Collective for GenEthics Action) deplores the searches of
which one of our Liège members was a victim on the morning of Thursday,
6 February 2003. During the search, documents on the dissemination of
GMOs into he environment and food supply in Belgium, as well as
computers, were seized by the Gent federal police. The officers present
did not give any details as to the reasons justifying such a method or
on their choice of home searched, which was that of someone who has
worked openly for several years on dossiers connected to genetics in
Belgium. Instead they simply linked this violation of a person's home to
an enquiry into several incidents involving the tearing up of transgenic
plots which have taken place since 23 May 2001.
We have also learnt today from the press that searches have also been
conducted in Flanders at the headquarters of the environmental
associations Velt and JNM (Youth Federation for Nature Study and
Environmental Protection), as well as at the general office of the
Ministry of the Environment, where all documents relating to the
cultivation of GMOs in Belgium, again with no explanation. Also in the
press it is now rumoured that there are "suspicions" of
"active implication" of various employees of the Ministry of
the Environment in the tearing up of the manipulated plants.
If the state of law rests in principle on the separation of powers
and the independence of the judiciary from the executive, these
coincidences and insinuations are here too well constructed and diffused
in the public space for it to be possible to see this as a
"dispassionate enquiry into judicial truth."
These searches were enacted almost two years after the first events
to which they are supposedly designed to clarify. On the other hand,
they have struck at the very moment that the pro-GMO interests in
Belgium have experienced an unprecedented setback, notably expressed in
the number of experimental releases of transgenic plants on our
territory, from 144 in 2000 to just one for the year 2003! The
multinational Bayer-Aventis, for example, has ended all its
contaminations in the field this year, in order to concentrate on the
possible commercialisation on the European scale of the notorious
rapeseed Terminator (MS8/RF3)
This revese suffered by the transgenic industry in our country is due
to the coming together of growing vigilance and the efforts of those who
have been targetted: citizens' groups such as CAGE on the one hand, the
offices of the Agalev (translator's note: i.e. Flemish Green Party)
ministers Magda Alvoet and Jeff Tavernier on the other - the groups are
those with which the Ministry has worked for two years on the
establishment of accessible information regarding the contaminated areas
and of intelligent decision-making procedures, including a
socio-economic evaluation of the impact of genetic manipulation on
agriculture. It is this project of Agalev and ECOLO (translator's note:
i.e. French-speaking Belgian Green Party) hope to defend before
Parliament in teh coming weeks, in the course of the transposition into
Belgian law of the EU directive 2001/18 on the experimental release of
GMOs (Translator's note: Actually, 2001/18 covers all deliberate release
of GMOs, including for commercial cultivation).
This is the plan which those who serve the transgenic interest, at
the heart of the VLD (right wing Liberals), MR (centre-right) and PS
(social democrats), blocked on 20th December at the Council of Ministers
(i.e. the Cabinet). They mean today to inflict their arrogance on those
who do not resign themselves to the prospect of a genetically
reconstituted world, one where a few hundred jobs in transgenic research
replace those of thousands of farmers and farmworkers here in our part
of the world and of the millions of small farmers in the South.
Everything appears well set for throwing their adversaries into
discredit, including a conspiracy theory, talk of "leaks" of
the location of transgenic sites, leaks coming from the employees of
Jeff Tavernier. However, anyone who has taken an interest in the GMO
question in Belgium knows that the local authorities where GMOs have
been officially released have been informed of this, since 2000, in the
public information bulletins on the website of the Biosecurity and
Biotechnology Service of the Ministry of the Environment! (http://biosafety.ihe.be)
This year the location and precise plan of manipulated apple trees at
Rillaar (Aarschot) and elsewhere is moreover accessible through the site
of the Joint Research Centre of the European Commission (http://www.jrc.org)
Here we have another example of what is at stake in this assault
carried out by the distortion of justice: preventing the maintenance of
a supply of information to the citizens sufficient for a real debate
each time that a new cultivation of manipulated plants is projected. It
makes us believe that to implicate oneself in the resistance to GMOs
requires acting clandestinely or playing at "double agents".
This spectacle is not worthy of the democracy which the Belgian
authorities claim to be defending.
In addition, deprived of our files and computers, CAGE is prevented
from functioning. The person searched was preparing for the trial which
begins on 10 March at Namur and in the context of which 13 Belgian,
French and Luxembourgeois citizens are arraigned for the public tearing
up of GMOs at Monsanto on 7 May 2000.
CAGE has begun the procedures for recovery of the material necessary
to our functioning.

Perquisitions contre les
opposants aux OGM en Belgique : enquête judiciaire ou coup bas
politique ?

Le CAGE (Collectif d'Action GénEthique) déplore les perquisitions
dont a été victime l'un de ses membres à Liège et à Bruxelles ce
jeudi 6 février 2003 au matin.
Lors de cette perquisition, des documents sur les disséminations
d'OGM dans l'environnement et l'alimentation en Belgique et des
ordinateurs ont été emmenés par la police fédérale de Gand. Les
agents présents sur place n'ont fourni aucune précision sur les motifs
qui auraient justifié une telle méthode et sur le choix du domicile
perquisitionné, celui d'un acteur travaillant ouvertement depuis
plusieurs années sur les dossiers liés au génie génétique en
Belgique. Ils se sont contenté de relier cette violation de domicile à
une enquête sur plusieurs arrachages de parcelles transgéniques ayant
eu lieu depuis... le 23 mai 2001.
Nous apprenons aujourd'hui par la presse que des perquisitions ont
également été opérées en Flandre au siège des associations
environnementales Velt et JNM (Jeugdbond voor Natuurstudie en
Milieubescherming), ainsi qu'au cabinet du Ministère de l'Environnement,
où la saisie de tous les documents se rapportant à la culture en
Belgique d'organismes génétiquement manipulés n'a là aussi été
accompagnée d'aucune motivation verbale. C'est également dans la
presse que s'étalent maintenant des "soupçons" sur "l'implication
active" de collaborateurs du ministre de l'Environnement dans des
arrachages de plantes manipulées.
Si l'Etat de droit consacre en principe la séparation des pouvoirs
et l'indépendance du judiciaire envers l'exécutif, les coïncidences
et les insinuations sont ici trop bien agencées et distillées dans
l'espace public pour qu'il soit possible d'y voir la seule "recherche
sereine de la vérité judiciaire".
Ces perquisitions sont réalisées près de deux ans après les
premiers événements qu'elles prétendent éclairer. Par contre, elles
frappent au moment même où la progression des intérêts pro-OGM en
Belgique connaît un coup d'arrêt sans précédent, ce que traduit
notamment le passage du nombre de disséminations expérimentales de
plantes transgéniques sur notre territoire de 144 en l'an 2000 à...
une seule pour l'année 2003 ! La multinationale Bayer-Aventis, par
exemple, a interrompu toutes ses contaminations en champs cette année,
pour se concentrer sur la possibilité de commercialiser à l'échelle
européenne son fameux colza Terminator (MS8/RF3).
Ce revers subi par l'industrie du transgénique dans notre pays est
dû à la conjugaison de la vigilance et des efforts de ceux qui sont
ici montrés du doigt : des associations de citoyens tel le CAGE d'un
côté, le cabinet des ministres Agalev de l'Environnement, Magda Alvoet
puis Jeff Tavernier, de l'autre. Autant les associations que le
Ministère oeuvrent depuis deux ans à l'instauration d'une information
transparente des populations contaminées et de procédures de décision
intelligentes, incluant une évaluation socio-économique de l'impact
des manipulations génétiques dans l'agriculture. C'est ce projet que
Agalev et ECOLO souhaitent défendre au Parlement dans les semaines qui
viennent, à travers la transposition en Belgique de la directive
européenne 2001/18 sur les expérimentations d'OGM.
C'est ce projet que les serviteurs des intérêts transgéniques, au
sein du VLD, du MR et du PS, ont bloqué le 20 décembre dernier au
Conseil des ministres. Ils entendent aujourd'hui faire payer leur
arrogance à celles et ceux qui ne se résignent pas à la perspective
d'un monde recomposé génétiquement, où quelques centaines d'emplois
de chercheurs transgénistes remplacent des milliers d'agriculteurs chez
nous et des dizaines de milliers de petits paysans dans le Sud.
Tout semble bon pour parvenir à jeter le discrédit sur leurs
adversaires, y compris une théorie du complot, l'évocation de "fuites"
sur la localisation des parcelles transgéniques, fuites venant de
collaborateurs ministériels de Jeff Tavernier. Or, quiconque
s'intéresse un minimum à la question des OGM en Belgique, sait que les
communes de disséminations officielles d'OGM sont renseignées depuis
2000 dans les fiches d'information du public sur le site du Service de
Biosécurité et de Biotechnologie dépendant du Ministère de
l'Environnement ! (http://biosafety.ihe.be). Pour cette année, la
localisation et le plan précis des pommiers manipulés à Rillaar (Aarschot)
est d'ailleurs accessible sur le site du Joint Research Centre de la
Commission Européenne (http://www.jrc.org/)...
Voilà aussi l'un des enjeux de l'assaut porté par le biais de la
Justice : empêcher le maintien d'une information aux citoyens
suffisante pour qu'un véritable débat naisse chaque fois qu'une
culture de végétaux manipulés est entreprise. Au besoin, en faisant
croire que s'impliquer dans la résistance aux OGM exige de verser dans
la clandestinité ou de jouer aux "agents doubles".
Ce spectacle n'est pas digne de la démocratie que les autorités
belges affirment défendre.
En outre, privé de ses dossiers et ordinateurs, le CAGE se voit
empêché de fonctionner. De même que la personne perquisitionnée de
se préparer pour le procès qui commence ce 10 mars à Namur et dans le
cadre duquel 13 citoyens belges, français et luxembourgeois
comparaîtront pour un arrachage public de cultures OGM chez Monsanto,
le 7 mai 2000.
Le CAGE entame dès lors les procédures lui permettant par toutes
voies de droit d'obtenir la restitution du matériel nécessaire à son
fonctionnement.
